Thank you for your interest in QuickSettle Plan offered by Legalpay Technology Private Limited (hereinafter referred to as “Legalpay”). By accessing or using this site, you indicate your unconditional acceptance of these terms of usage. We reserve the right, in our sole discretion, to update or revise these terms of use. Your continued use of the site following the posting of any changes to the terms of use, shall constitute deemed acceptance of those changes.
 

You may use the Site only in accordance with and subject to these Terms of Use and the Site’s privacy policy. Once you complete and submit your details, you have opted in to receive email or any other marketing communication from our affiliates or us. You may not use the Site for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity, which infringes the rights of Legalpay.

 

1. Services

   1. You hereby confirm to register with us to avail The QuickSettle Plan offered by Legalpay.

   2. You hereby understand and acknowledge that the information requested from you is used for the various purposes as set out in our Privacy Policy, including for the purposes of our complying with various laws, regulations, and guidelines (including Know Your Customer (KYC) norms / Anti Money Laundering (AML) standards / Combating of Financing of Terrorism (CFT) / Obligation of banks under the Prevention of Money Laundering Act, 2002) as promulgated by the Government of India from time to time. You further acknowledge that if you do not provide the requested information to Legalpay; Legalpay or its partners will be unable to continue providing their services to you.

   3. You confirm that all information given to Legalpay (whether through Legalpay’s online form or otherwise) is true, correct, and not misleading. You agree to provide any additional documents to Legalpay or any of its partners as may be required from time to time.

   4. Upon clicking ‘I Accept’ you and your successors/ heirs/ executors shall be bound by the terms of The QuickSettle Plan. You understand and agree that Legalpay shall charge you a non-refundable subscription fee or a technology usage fee for facilitating The QuickSettle Plan to be availed by you and you agree to pay the same. You must understand that this fee may not be refundable to you even if The QuickSettle Plan is cancelled for any reason whatsoever.

   5. You hereby understand that when you subscribe to The QuickSettle Plan, you authorise Legalpay and its lending partners (Banks and NBFCs) to fetch your credit information records from credit bureaus, and any information available to Legalpay through any of its sources, including those at credit information companies (CICs); those at fraud prevention agencies (FPAs) and its own records, for assessing your creditworthiness, verifying identity to prevent and detect crime and money laundering.

 

1. Eligibility

   1. This Site is intended solely for Users who, are eighteen (18) years of age or older, and any registration by, use of, or access to the Site by any person under 18 is unauthorized, unlicensed, and in violation of these Terms of Use. 

   2. By using the Service or the Site, you represent and warrant that you are 18 years or older and that you agree to and will abide by all of the terms and conditions of these Terms of Use.

   3. If you violate any of these Terms of Use, or otherwise violate an agreement between you and us, the Company may terminate your account, delete your profile and data, and/or prohibit you from using or accessing the Service or the Site (or any portion, aspect or feature of the Service or the Site), at any time in its sole discretion notice, including without limitation if it believes that you are under 18. 

   4. Legalpay is a technology service provider and we facilitate the application/processing/disbursal and closure of loans. The terms and conditions of the lender apply independently and supersede any information present here.

 

1. Indemnification

By using this Site, you agree to indemnify, hold harmless, and defend Legalpay, its subsidiaries, divisions, and affiliates, and their respective officers, directors, employees, successors, agents, partners, contractors, vendors, representatives, and affiliates, from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys’ fees, resulting directly or indirectly from a claim (including without limitation, claims made by third parties for infringement of intellectual property rights) by a third party that arises in connection with

1. Your use or misuse of the Site;

2. Obtain unauthorized access to any computer system

3. Your breach of the Terms of Use;

4. Your violation of any law or the rights of a third party; or

 

1. Limitation of Liability

   1. In no event shall Legalpay or its directors, employees or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the site or the service or any of the site content or other materials on or accessed through the site, even if the company is aware or has been advised of the possibility of such damages. 

 

1. Termination

   1. Legalpay may at any time suspend and/or terminate your subscription to The QuickSettle Plan for any reason whatsoever, including for reasons of breach by the User of the T&Cs, and/or any of the policies made available on the Legalpay Platform by giving a notice 7 (Seven) days prior to such termination.

   2. The User may terminate its arrangement with Legalpay in relation to The QuickSettle Plan by writing to the Legalpay customer care team and after repayment of all amounts due and payable to Legalpay.

   3. In the event of any termination or suspension of services or the User Account, the User shall be liable to pay in full all amounts due and payable to Legalpay as set out in the The QuickSettle Plan or credit amount due as provided under the T&Cs.

 

1. Refund Policy

   1. Any successful payment made by a subscriber, as subscription fee for The QuickSettle Plan shall be non-refundable.

   2. Legalpay shall not be responsible for a refund agsint any monetary loss caused to the subscriber due to any technical hindrance/ payment system failure/ server failure, while effectuating payment through any or the designated payment gateway, from the subscriber’s bank.

 

 

1. Governing Law and Dispute Resolution

   1. Notwithstanding anything to the contrary contained herein, any dispute, controversy and/or claim arising out of and relating to the T&Cs of The QuickSettle Plan, including its construction, interpretation, meaning, scope, operation, effect and / or validity thereof (“Dispute”), shall be resolved by mediation /or arbitration, as the case may be, administered by Bharat Dispute Resolution (BDR), through an independent mediator/ arbitrator, in accordance with its Dispute Resolution Rules (“Rules”).

   2. The parties agree that the arbitration shall be before a sole arbitrator mutually appointed under the Rules. The juridical seat of arbitration shall be New Delhi, India. The language of arbitration shall be English. The law governing the arbitration proceedings shall be Indian law. The decision of the arbitrator shall be final and binding on the parties. Subject to the above, the competent courts at the seat shall have exclusive jurisdiction.

   3. The parties agree to carry out the arbitration proceedings virtually through the online dispute resolution (“ODR”) platform of (www.bharatdisputes.com) and, for such purpose, the email addresses and / or mobile numbers available, provided or otherwise referenced in the contract shall be considered. Each party shall be responsible for intimating / institution in the event of any change in its email address and/or mobile number throughout the arbitration proceedings. In the event the arbitration proceedings cannot be administered virtually in the opinion of the arbitrator, the proceedings shall be conducted physically, and the venue of the proceedings shall be as determined by the arbitrator having regard to the circumstances of the case, including the convenience of the parties.

   4. You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non-convenience or any other basis.

 

1. Copyright and Trademark

   1. All related icons and logos are registered trademarks or service marks of Legalpay in various jurisdictions and are protected under applicable copyright, trademark, and other proprietary rights Applicable Laws. The unauthorized copying, modification, use, or publication of these marks is strictly prohibited. 

   2. All content on the Website and Service is the copyright of Legalpay except the third-party content and any link to a third-party website on our website.

   3. Any systematic retrieval of Legalpay content to create or compile, directly or indirectly, a collection, compilation, database, or directory (whether through robots, spiders, automatic devices, or manual processes) without written permission from Legalpay is prohibited.

   4. In addition, the use of the content for any purpose not expressly permitted in this agreement is prohibited and may invite legal action. As a condition of Your access to and use of Legalpay’s Services, you agree that You shall not use the Website and/or its Service to infringe the intellectual property rights of others in any way. Legalpay reserves the right to terminate the account of a User(s) upon any infringement of the rights of others in conjunction with the use of Legalpay’s Service, or if Legalpay believes that the User’s conduct is harmful to the interests of Legalpay, its affiliates, or other Users, or for any other reason in Legalpay’s sole discretion, with or without cause.

 

1. Consent

   1. By clicking on the tab/button/ checkbox of “Legalpay” or any other button/checkbox of similar nature, 

      1. You confirm that you are eligible under Applicable Law to contract with Legalpay, 

      2. You consent to conduct transactions, accept the terms and conditions of this Agreement and the Privacy / Policy as displayed on the Website and 

      3. You consent to receive communications, notices and information from us through post or other physical medium or electronically (whether through SMS, emails, phone calls, and automated phone calls). 

      4. Electronic communications shall be deemed to have been received by you when we send the electronic / communication to the email address/mobile number/details provided by You during the sign-up process as per our records, or when we post the electronic communication on the Website.

 

1. Force Majeure

Legalpay or its partners shall not be liable for its failure to perform under the T&Cs as a result of the occurrence of any force majeure events including an act of God, fire, wars, sabotage, civil unrest, labour unrest, the action of statutory authorities or local or central governments and/or change in Applicable Law, that may affect the performance of Legalpay or the payment gateways of Legalpay.
